- "At all times material to this appeal, Sudan was not a State Party to the Statute of the International Criminal Court, popularly known as the ‘Rome Statute’. But, it was a Member State of the United Nations, and was bound as such by the UN Charter"
- Note : USA Regarding The Rome Statute : "The United States is not a party to the Rome Statute, which established the International Criminal Court (ICC) in 2002. The U.S. participated in the negotiations of the treaty but was one of only seven countries that voted against it in 19981. President Bill Clinton signed the Rome Statute in 2000, indicating an intention to consider ratification, but he did not submit it to the Senate for advice and consent1. Subsequent administrations have varied in their approach to the ICC, with the George W. Bush administration stating it would not join the ICC, while the Obama administration re-established a working relationship with the court as an observer1. As of March 2023, the U.S. maintains its position as a non-party state12."
